So, one of our conservative R&P brothers (actually I'm not sure he is a guy, but I'm making an educated guess) made a comment regarding flag burning and Freedom of Speech, and I thought rather than derail the other thread I'd make a new one.
So, this is a fairly big issue in the US, large numbers of conservatives (and some liberals) think, "desecration of the flag of the United States," should be made illegal. BUT, since the Supreme Court decided that flag burning was protected under the 1st Amendment right to Free Speech, and subsequently upheld that decision when Congress passed a Flag Protection Act, those who oppose flag burning have only one viable method to get it banned, a Constitutional Amendment.
From 1995 to 2006, an amendment was proposed during every congress, and each time it passed the House of Representatives but failed in the Senate, or just didn't reach it (for reasons I'm not sure of, ran out of time I guess), except in 2006, when in failed in both houses. For some reason, it hasn't been voted on since, though it may have been proposed. It should be noted that the amendment always received a majority of the vote in both houses, but not the two thirds majority required to go on to the state legislatures.
So that's where we're at now, and my question to you, dear reader, is this:
Do you believe an amendment should be made to the US constitution preventing people from burning the US flag in the USA?
I don't have the same attachment to the US flag as many Americans will, being British, so my opinion will be coloured by that, but I am of the firm belief that Freedom of Expression is a human right, not just a civil right, and that flag burning falls under this, and so should be protected.
